1. Definitions

In these Terms and Conditions, the following definitions apply:

2. Acceptance of Terms

By using our website, submitting an enquiry, or bringing a watch to our workshop, you confirm that you have read and accepted these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

You confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are bringing a watch on behalf of another person, you represent that you have authority to do so.

You also confirm that the watch you bring to us is your own property, or that you have the owner's authority to submit it for service.

3. Services Provided

Jam Permata provides the following watch repair services at our Kuala Lumpur workshop:

All services are carried out in person at our workshop. We do not currently offer postal or courier-based service. Services are available to clients in Malaysia and to visitors to Kuala Lumpur.

4. Service Delivery Terms

The following conditions apply when you bring a watch to us for service:

We reserve the right to decline any watch that, upon examination, falls outside our scope of competence or requires materials we cannot responsibly source.

5. Payment Terms

All prices are stated in Malaysian Ringgit (RM). Payment is due in full upon collection of your watch. We accept cash and common electronic payment methods. Prices are as stated on our website and confirmed at the time of service agreement.

Where additional parts are required, the cost will be agreed with you before ordering. Parts costs are billed separately from the stated service fee unless otherwise confirmed in writing.

Watches not collected within 60 days of notification of completion may be subject to a storage fee. We will attempt to contact you by the contact details provided before any storage fee is applied. If a watch is not collected within 180 days despite reasonable notification attempts, we reserve the right to discuss further arrangements with you.

6. Your Responsibilities

When engaging our services or using our website, you agree to:

7. Intellectual Property

All content on this website — including text, design, images, and layout — is the property of Jam Permata and may not be reproduced, copied, or used without our written permission.

You are granted a limited, non-exclusive licence to access and view the website for the purpose of obtaining information about our services. This licence does not extend to downloading, modifying, or republishing any part of the website's content.

8. Disclaimers

Our services are provided with care and skill. However, watch repair involves working with components that may already be in a fragile, worn, or previously modified state. We cannot warrant specific rate performance outcomes in all cases, particularly for movements where components have deteriorated beyond a point that service alone can address.

The vintage assessment service provides a written view of the watch's condition at the time of examination. It is not a valuation for insurance or sale purposes, and does not constitute a warranty about the watch's future performance.

Our website is provided for informational purposes. While we take care to keep it accurate and up to date, we make no representation that all content is complete or error-free.

9. Limitation of Liability

To the extent permitted by Malaysian law, our liability to you in connection with any service shall not exceed the fee paid for that service. We are not liable for indirect, incidental, or consequential losses arising from the service, including loss of enjoyment of the watch during the service period.

This limitation does not apply to losses caused by our negligence or wilful misconduct, or to rights you hold under the Consumer Protection Act 1999 (Malaysia) which cannot be excluded by contract.

10. Indemnification

You agree to indemnify Jam Permata against any claims, losses, or expenses arising from your breach of these Terms, your misrepresentation about ownership of the watch submitted, or your unlawful use of our website.

11. Termination of Service Agreement

Either party may withdraw from a service agreement before work has commenced, without penalty. If you wish to cancel a service that is already in progress, you may be charged for work completed to that point.

We reserve the right to decline to complete a service if circumstances arise that make it inappropriate to do so, in which case we will return your watch in the condition in which it was received and charge only for any work that was completed with your prior consent.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. In the event of a dispute arising from our services or these Terms, we ask that you contact us first at [email protected] to resolve the matter informally.

If informal resolution is not possible, disputes shall be submitted to the jurisdiction of the courts of Kuala Lumpur, Malaysia. Nothing in this clause limits your rights under the Consumer Protection Act 1999 (Malaysia).

13. General Provisions

14. Changes to These Terms

We may revise these Terms from time to time. The revised version will be published on this page with an updated date. We encourage you to check this page periodically.

Continued use of our website or services after changes are published constitutes acceptance of the updated Terms.
